Investigation Launched into Hotel Chains Over Data Sharing Practices

The Competition and Markets Authority has initiated an investigation into leading hotel chains including Hilton, Marriott, and InterContinental Hotels Group. This scrutiny arises from concerns over allegations that these companies may have engaged in improper data sharing through a data analytics tool owned by CoStar. The situation raises questions about fair competition and the potential impact on consumers in the hospitality sector.

At the heart of the investigation is the claim that these global hotel companies utilised CoStar’s data analytics tool STR to share competitively sensitive information. This sharing of data could enable the companies to predict one another’s actions and co-ordinate pricing strategies. The CMA has emphasised that sharing such information can significantly distort normal competitive conditions.

The necessity for a thorough investigation stems from the need to ensure that emerging technologies, such as pricing algorithms, do not compromise market fairness. These algorithms generally analyse past and present data to assist in setting pricing levels, thereby influencing consumer choices.

The CMA stated that while certain data-sharing practices can enhance competition and reduce costs, they must remain within legal boundaries to avoid collusion. The organisation has made it clear that no assumptions should be made regarding legal violations at this preliminary stage.

As part of their compliance, spokespeople from both Hilton and InterContinental Hotels Group have expressed willingness to cooperate fully with the CMA’s inquiries. This lack of information-sharing has already led to a notable decline in share prices for InterContinental Hotels Group, which fell by five per cent in early trading.

The investigation is a significant development for the hospitality industry and will likely have substantial implications for how data analytics tools are used in shaping competitive strategies in the future.
