Microsoft Claims Competition Watchdog Made Critical Error in Cloud Computing Investigation

The tech giant Microsoft has launched a scathing criticism of Britain’s Competition and Markets Authority (CMA), asserting that the watchdog made a “fundamental mistake” by failing to consider artificial intelligence’s impact on the cloud computing market.

The controversy stems from the CMA’s January investigation, which concluded that Microsoft was leveraging its dominant software position to impede competition from rivals Amazon Web Services and Google. The regulatory body’s provisional decision notably stated that AI had “no significant direct impact” on cloud market competition.

Microsoft’s detailed response accused the CMA of taking an outdated perspective by disregarding AI’s transformative influence on the sector. The company emphasised that the regulator’s stance on AI infrastructure having “limited relevance” to cloud computing represents a crucial oversight that undermines the entire investigation’s credibility.

The timing of this dispute is particularly significant as tech companies pour vast resources into developing AI-capable data centres to support advanced models like Google’s Gemini and OpenAI’s ChatGPT. These developments require substantial computing power for both training and operational phases.

The CMA’s position has attracted heightened scrutiny, particularly following recent leadership changes. The appointment of former Amazon UK head Doug Gurr as chairman, replacing Marcus Bokkerink, has added another layer of complexity to the ongoing investigation.

Microsoft warns that regulatory intervention based on this incomplete market assessment could prove counterproductive, potentially hampering the UK’s goal of fostering a robust, competitive cloud services environment.
