
Sam Bankman-Fried, the former chief executive of the collapsed FTX cryptocurrency exchange, has submitted a request for a retrial. The 33-year-old is currently serving a 25-year prison sentence after being convicted of defrauding customers, which resulted in significant financial losses for those involved. Bankman-Fried argues that he was indicted on unfounded charges, claiming he never embezzled funds from FTX.
In his court filing, Bankman-Fried presents the notion that two former executives from FTX, Daniel Chapsky and Ryan Salame, did not testify during the initial trial. He asserts that their testimonies could provide new perspectives on the company’s financial situation. Salame, who pleaded guilty to charges in a separate case, is serving over seven years in prison, while Chapsky highlighted that he refrained from testifying due to concerns over potential media scrutiny and government retaliation.
Bankman-Fried contends that the testimonies provided by the government’s witnesses and the narrative constructed by prosecutors were misrepresented. He claims that a pressurised Department of Justice coerced former employees to withdraw from his defence, including threatening one prospective witness with unfounded political charges.
The request to replace presiding Judge Lewis Kaplan, who oversaw the original trial, accompanies Bankman-Fried’s motion. He is representing himself in this legal manoeuvre, while his defence team has also filed an appeal against the conviction, which is currently pending review at the Second Circuit Court of Appeals in New York.
At his trial, prosecutors characterised the mismanagement of FTX and Alameda, the hedge fund associated with it, as a “fraud of epic proportions.” Bankman-Fried admitted to making errors in managing FTX, yet maintained that he never misappropriated customer assets. However, a federal jury ultimately found him guilty of seven counts related to the misappropriation of an estimated 8 billion dollars in customer funds.
