Elon Musk has accused Sam Altman of appropriating a charity in a lawsuit that commenced in California. This legal action is centred on allegations that Altman and OpenAI, the company co-founded by Musk, betrayed its original mission by converting the organisation into a profit-making entity.

Musk, currently the world’s wealthiest individual, claims that he invested 38 million dollars into OpenAI when it was established in 2015 as a non-profit organisation. The lawsuit alleges that the transformation into a for-profit company has undermined the very ethos of ensuring that artificial intelligence benefits humanity.

OpenAI, now one of the most valuable companies globally, valued at over 850 billion dollars, contests Musk’s claims. Legal representatives for OpenAI assert that Musk supported the development of a for-profit model during his tenure. They argue that the lawsuit is driven by Musk’s desire to diminish a competitor in the AI sector.

Musk expressed concern, stating that permitting the appropriation of a charity would threaten the foundation of charitable giving in the United States. He seeks 150 billion dollars in damages, aimed at being funneled to OpenAI’s charitable foundation. Additionally, Musk wants a reinstatement of OpenAI’s non-profit status, removal of Altman and Greg Brockman from their executive roles, and Altman’s removal from the board.

During the trial, OpenAI’s lawyer, Bill Savitt, contended that Musk was motivated by self-interest. He claimed that Musk’s aim in initiating the lawsuit was to secure the leadership of OpenAI after failing to gain control. The ongoing case raises significant questions regarding the ethical implications of transforming non-profit entities into for-profit corporations within the technology sector.

Musk’s assertions include claims of breach of charitable trust and unjust enrichment. The courtroom proceedings are expected to attract considerable attention, with both Musk and Altman scheduled to testify, alongside Microsoft CEO Satya Nadella.
