Alaska court dismisses lawsuit over offshore drilling restrictions

A federal judge in Alaska has dismissed a legal challenge brought by environmental groups against the US administration’s decision to permit offshore drilling in previously restricted waters. US District Judge Sharon Gleason issued the ruling on 24 August, determining that the lawsuit was premature because drilling activities in the affected federal waters are not currently imminent. The decision effectively halts the current proceedings without addressing the core constitutional questions raised by the plaintiffs.

The case, originally filed in February 2025, argued that President Donald Trump exceeded his legal authority by reversing restrictions established by his predecessor, Joe Biden. Environmental organisations, including the Northern Alaska Environmental Center, contended that opening protected coastal areas to oil and gas activities would cause significant adverse impacts on endangered species, sensitive ecosystems and local Native American communities. However, Judge Gleason did not rule on whether the president possesses the power to revoke these prior restrictions, noting instead that the threat of immediate harm was insufficient to warrant judicial intervention at this stage.

Legal representatives for the plaintiffs have indicated they intend to pursue the matter further if leasing or drilling efforts commence in the disputed zones. George Torgun, a senior attorney at Earthjustice’s Oceans Programme, expressed disappointment with the ruling but affirmed the group’s position that the administration’s actions are unlawful. He stated that the organisation will continue to maintain its claims and is prepared to litigate again should offshore activities become imminent. The dispute arises from executive orders issued shortly after Trump took office, which aimed to support hydrocarbon production and roll back previous climate initiatives.
